A BILL

TO END THE PRACTICE OF MUNICIPAL FLUORIDATION.

 

SECTION 1. SHORT TITLE -- ANTI-FLUORIDATION ACT

 

SECTION 2. FINDINGS

 

(a)    On August 5, 2005 eleven EPA employee unions requested that the Maximum Contaminant Level Goal (MCLG) for fluoride be set at zero because municipal fluoridation has been linked to bone cancer.

 

(b)   For decades municipalities have been adding chemicals to drinking water supplies for the purpose of increasing the amount of fluoride in water under the pretense that doing so reduced the amount of dental carries in children and adults.

 

(c)    Studies have shown that this practice may be detrimental to human health, but many of these studies have been ignored, altered or hidden. 

 

(d)   A recent study at Harvard University by Dr. Elise Bassin shows a link between fluoride in drinking water and osteosarcoma in boys.  Studies by Dr. Phyllis Mullenix shows a link between fluoride and nervous disorders such as ADD, hyperactivity and reduced IQ in children.  Areas where water supplies are fluoridated have higher rates of hip fractures in senior citizens.  These, and many more studies, show that the practice of fluoridation is not safe. 

 

(e)    The FDA has not approved fluoride, or the chemicals used for fluoridation, for use as an internal medication.  In fact, fluoride is only known to prevent cavities while in the mouth.  Once swallowed there is no benefit to dental health. 

 

(f)     The practice of fluoridation is a form of mass medication through water supplies.  This is not only a violation of human rights; it is a violation medical ethics as set forth in the Nuremberg Code. 

 

(g)    Although the rate of dental carries has decreased in areas that are fluoridated, similar rates of decline have been seen in areas that are not fluoridated.  This can be attributed to better dental hygiene in brushing, using mouth washes, flossing and fluoride used in products not meant to be swallowed such as toothpaste and mouth wash. 

 

(h)    Proponents of fluoridation claim that it is safe and effective, but refuse to acknowledge studies that show the opposite. 

 

(i)      On August 5, 2005 eleven EPA employee unions representing approximately 7000 scientists wrote to several EPA administrators, senators and representatives calling fluoridation a human carcinogen and requesting the maximum level goal for fluoride to be set at zero.  This bill is in support of these scientists.

 

SECTION 3. REDUCE THE MAXIMUM CONTAMINATE LEVEL GOAL OF FLUORIDE IN DRINKING WATER TO ZERO

 

(a)    Upon passage of this bill the National Toxicology Program (NTP) must classify fluoride as a human carcinogen and set the Maximum Contaminant Level Goal (MCLG) for fluoride to zero.

 

(b)   Any municipality or water district that is currently adding any chemical to water for the purpose of increasing the level of fluoride in drinking water must halt such practice within 30 days of this bill becoming law.

 

(c)    Any municipality or water district that is not adding any chemical to its water supply for the purpose of raising the level of fluoride must not start such an addition to the water supply. 

 

(d)   Any addition of fluoride to any water supply destine for human consumption will be a violation of federal law.

 

(e)    Any group or individual guilty of this violation will be subject to a fine of up to ten thousand dollars per day for each day that the violation continues. 

 

(f)     Any individuals in authority who authorize this violation will be subject to imprisonment for up to ten years.

 

SECTION 4. SEVERABILITY CLAUSE

 

If any provision of this Act or the application thereof to any person or circumstance is held invalid for any reason in any court of competent jurisdiction, the invalidity does not affect other provisions or any other application of this Act which can be given effect without the invalid provision or application, and for this purpose the provisions of this Act are declared severable.
